Explanation of Residency Requirements:

You or your spouse must be either (1) a domiciliary of Georgia or (2) be a military service member stationed in Georgia. In either scenario you or your spouse must be domiciled or stationed in Georgia for at least six months prior filing the Petition for Divorce with the county court. You are domiciled in Georgia if you live in Georgia with the intention of making Georgia your permanent home. For example, where do you primarily live? Sleep at night? Get your mail? What address is on your driver's license? What address is on your federal tax return? If Georgia, then you are domiciled in Georgia. Military service members do not have to be domiciled in Georgia but simply stationed in Georgia. If you or your spouse is a Georgia resident and either of you is in the military or on government service you are considered a domiciliary of Georgia if Georgia is your home state.
