Step 5: Divorce Granted

Court Fee: We’ve standardized the mandatory court filing fee and processing fee to $280. The court fee is paid directly to the Georgia Superior Court. ✅ Georgia Residency Requirements

To file for divorce in Georgia, at least one spouse must meet the state’s six-month residency requirement.

Under Georgia law (O.C.G.A. § 19-5-2):

  • If you are filing for divorce, you must have lived in Georgia as a bona fide resident for at least six months before filing.
  • If you are not a Georgia resident, you may still file in Georgia if your spouse has lived in Georgia — and in their current county — for at least six months.
  • If you or your spouse are a member of the military, and have been stationed in Georgia for at least one year, you may also file for divorce in Georgia.

Online Notarization Requirements:

Our website offers secure online notarization for individuals filing in a county that accepts it. Not all counties in Georgia permit online notarization. If your filing county does not accept remote notarization, you’ll need to visit a local, in-person notary to complete the process.

If your county does allow online notarization, the process is completed using real-time audio-video technology, allowing you to sign your divorce documents from anywhere — no in-person notary visit required.

To participate in online notarization, each signer must pass identity verification through knowledge-based authentication (KBA) or biometric analysis. You’ll also need one of the following valid forms of government-issued ID:

  • A state-issued Driver’s License, Real ID, or Identification Card
  • A U.S. Passport issued by the U.S. Department of State
  • A foreign passport stamped by the U.S. Bureau of Citizenship and Immigration Services
  • A Permanent Resident Card (Green Card)
